1. Acceptance of Terms

By accessing or using Botify CRM ("Service"), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Service.

2. Description of Service

Botify CRM provides a cloud-based customer relationship management (CRM) platform including features such as contact management, SMS messaging, automation workflows, appointment scheduling, and lead capture tools for service businesses.

3. SMS Messaging Terms

By providing your phone number and opting in to SMS communications, you agree to the following:

  • You consent to receive recurring automated SMS messages from Botify CRM and its sub-account users.
  • Message frequency varies based on account activity and settings.
  • Message and data rates may apply based on your carrier plan.
  • To opt out, reply STOP to any message. You will receive a confirmation and no further messages will be sent.
  • To get help, reply HELP or contact us at admin@botifycrm.com.
  • Carriers are not liable for delayed or undelivered messages.

Opt-In Disclosure: By submitting a form on this website with your phone number and checking the SMS consent checkbox, you expressly agree to receive SMS text messages from Botify CRM. Consent is not a condition of purchase.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms.

5. Acceptable Use

You agree NOT to use Botify CRM to:

  • Send unsolicited messages (spam) to contacts who have not opted in
  • Violate any applicable laws, including the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act
  • Transmit harmful, illegal, or offensive content
  • Impersonate any person or entity
  • Attempt to gain unauthorized access to our systems

6. Subscription & Billing

Botify CRM is offered on a subscription basis. By subscribing, you agree to pay the applicable fees. Plans auto-renew unless cancelled before the renewal date. Refunds are not provided for partial billing periods. We reserve the right to change pricing with 30 days' notice.

7. Free Trial

New accounts may be eligible for a 14-day free trial. No credit card is required to start a trial. After the trial period, continued access requires a paid subscription.

8. Intellectual Property

All content, trademarks, and software associated with Botify CRM are the property of Botify CRM or its licensors. You may not reproduce, distribute, or create derivative works without prior written consent.

9. Limitation of Liability

To the maximum extent permitted by law, Botify CRM shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the three months preceding the claim.

10. Termination

You may cancel your account at any time from your account settings. We may terminate or suspend access for violations of these Terms, with or without notice.

11. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Hidalgo County, Texas.

12. Changes to Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the Service after changes constitutes acceptance.
